FREE Public Wi-Fi Internet Terms and Conditions of Use
.Customer" means you.
"EOL" means Enternet Online Limited
"EOL Public Wi-Fi" is the FREE Public Wireless High Speed Internet Access network providing coverage in and around the Bay of Plenty region of New Zealand.
"Service" means the provision of FREE Wi-Fi Internet to the Customer.
The Customer is responsible for exercising legal, ethical, moral and appropriate Internet and E-mail behaviour when using EOL FREE Public Wi-Fi.
EOL reserves the right to terminate or restrict any Customer's access to or usage of EOL
FREE Public Wi-Fi at any time if these Terms of Use are breached.
You must comply with all directions issued by EOL relating to use and access to EOL FREE Public Wi-Fi.
The maximum session idle timeout is 10 minutes. Your session will automatically end after this time. If you manually log-off from the service, your session will automatically end at this time.
You are liable for all fees incurred with third parties during your session on the Internet while using your EOL FREE Public Wi-Fi account whether it's use was authorised by you or not.
(a) If data security is a concern, EOL recommends that Customers adopt the following
Personal hardware or software firewall;
Regularly update your virus scanner;
Use the Paid EOL Public Wi-Fi Encrypted Service, as the Free service offers no encryption
of transmitted data
(b) The Internet is sometimes unreliable and insecure. EOL does not guarantee the security of EOL
FREE Public Wi-Fi or the systems (including the Internet and your hardware and software) used to access FREE EOL Public Wi-Fi, or any information that passes through such systems.
(c) We do not provide any warranties that EOL FREE Public Wi-Fi is undisrupted, delay free, constant, error free or free from malicious software such as computer viruses.
(d) We are not responsible for:
The functionality or content of any internet site or service accessed via EOL FREE Public Wi-Fi;
loss caused by factors which could reasonably be considered to be outside our control such
as faults in third party equipment;
loss of data or loss of profits or revenue; and any loss to the extent that it is caused by the Customer, for example, through your negligence or breach of contract.
(e) The Customer will indemnify EOL for any loss of damage we may suffer as a result of any
negligent act performed by you.
(f) You may stop using EOL Public Wi-Fi at any time.
(g) We may immediately suspend, terminate or limit your access to EOL Public Wi-Fi if:
you are in breach of the Terms of Use;
we believe on reasonable grounds that there is a real risk of serious loss or damage to us or a third party if we do not suspend, terminate or limit your access;
there is an emergency;
there is an unusually high use of the Service
